Idaho Notary
A public notary oversees the signing of documents and verifies the identity of the individual signing. A notary in Idaho must meet specific requirements and avoid administering over the signing of documents where he could have a conflict of interest.
Facts
The Idaho secretary of state appoints a public notary for six years. To be a notary, a person must be 18 and a resident of Idaho, and not have any serious criminal convictions in the past 10 years. A prospective notary must have acceptable skills for reading and writing in English.
Conflict of Interest
A public notary should avoid notarizing a document that would create a legal conflict of interest. An example of this is notarizing a document for a spouse where the notary shares the same beneficial interest, or notarizing a document, like community property, with the notary's name on it.
Punishment
If an Idaho notary public performs a notarial act that she has a conflict of interest in, the transaction can be disqualified.
